Terms of Service

These Terms of Service ("Terms") govern your access to and use of Planespotted (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
Planespotted is a community platform for discovering and sharing planespotting locations. In these Terms, "we", "us" and "our" refer to the operator of Planespotted.
2. Eligibility & accounts
You are responsible for your account and for keeping your password secure. You must provide accurate information and are responsible for all activity under your account. You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service.
3. User content
The Service lets you submit content, including spot locations, descriptions, photos, ratings and reviews ("User Content"). You retain ownership of your User Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and distribute that content for the purpose of operating and promoting the Service.
You are solely responsible for your User Content.You represent and warrant that you own or have all necessary rights, licences and permissions to submit it, and that it does not infringe any third party's intellectual property, privacy, or other rights, and does not violate any law.
4. Copyright & intellectual property of uploads
You must not upload photos or other material that you do not own or do not have permission to use. We do not verify the ownership, rights, or legality of User Content, do not endorse it, and do not claim ownership of it, and we are not responsible or liable for any User Content, including any content that infringes copyright or other intellectual property rights. We have no obligation to monitor User Content, but we may use automated and manual moderation to detect and remove content that violates these Terms, and content our systems flag as unsafe may be removed automatically. Exercising this right does not make us responsible for User Content. Responsibility for the legality of any upload rests entirely with the user who submitted it.
If you believe content on the Service infringes your copyright, contact us at contact@planespotted.com with (a) identification of the work, (b) the location of the material on the Service, (c) your contact details, and (d) a statement that you have a good-faith belief the use is unauthorised. We will remove infringing content that is properly reported and may terminate repeat infringers.
5. Prohibited use
You agree not to: submit unlawful, infringing, misleading, or harmful content; harass or endanger others; encourage trespassing or unsafe behaviour near airports or aircraft; scrape or misuse the Service; attempt to breach security or access data that is not yours; or use the Service in violation of any applicable law or airport/airfield rules.
6. Safety & accuracy disclaimer
Spot locations, weather, sun, wind and runway information are provided for general informational and photography-planning purposes only. They are sourced from third parties and the community and may be inaccurate, incomplete, or out of date. The Service must never be used for aircraft navigation, flight operations, or any safety-critical purpose. You are solely responsible for your own safety, conduct, and for complying with all laws, property rights, and airport regulations when visiting any location.
7. Subscriptions & payments
Planespotted Pro is billed through Stripe on a recurring basis until cancelled. Prices are shown at checkout. You can cancel at any time from your profile; access continues until the end of the current billing period. Except where required by law, payments are non-refundable.
All payments are processed solely by Stripe, and by subscribing you agree to Stripe's terms and privacy policy. Stripe — not Planespotted — is responsible for processing payments and handling your payment information; we never receive or store your full card details.To the maximum extent permitted by law, Planespotted is not liable for any loss or damage arising from payment processing, including errors, unauthorised or fraudulent charges, declined transactions, or the acts or omissions of the payment processor. Any payment or chargeback dispute is handled in accordance with Stripe's policies.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content is accurate.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM (a) your use of or inability to use the Service; (b) any User Content or third-party content, including any copyright or other infringement by users; (c) your visiting of any location; or (d) any reliance on information provided by the Service. Our total aggregate liability for any claim relating to the Service shall not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50.
10. Indemnification
You agree to indemnify and hold harmless Planespotted and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or of any law or third-party right — including any claim that your uploads infringe a third party's copyright or other rights.
11. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or to protect the Service or its users. You may stop using the Service and delete your account at any time.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
13. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreements. Our failure to enforce any right or provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
14. Governing law & disputes
These Terms are governed by the laws of Canada and the applicable province in which the operator is based, without regard to conflict-of-laws rules. You agree that the courts located in Canada have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction.
